Terms and conditions for The Canine Activity Centre

These are the terms and conditions on which we allow you to book and use our centre. When you make a booking with us, whether online through our booking system, via our social media channels or by calling or emailing directly, you are expressly accepting these terms and agreeing to abide by our rules and regulations.
We have made every attempt to keep to plain English and no legal jargon so that understanding them is easy, and should you have any queries about anything in these terms and conditions, please contact us via email at canineactivitycentre@hotmail.com.

Definitions
‘We/us’ – The Canine Activity Centre Ltd
‘your dog/s’ – means the dog or dogs that come to the centre with you – whether they are yours or not
‘the dog field’ – meaning the centre you have booked at The Canine Activity Centre
‘you’ - refers to you, the individual, business or organisation that has booked the centre

Our Contract with You

When you make a booking with us, whether it’s via the booking site, phone, email or any other method, we and you are entering into an agreement – ‘a contract’ (in legal terms). This contract is subject to these terms and conditions and because we may update them or change them at any point in time, we ask you to agree to them each time you make a booking. Any dispute or claim concerning this contract between us, or anything arising from it, will be dealt with by the courts of England and Wales.


The basics of our contract with you are the following:

  • We take payment at the time of booking and until such payment has been made, your booking is not confirmed

  • You will know the total price, including tax where applicable, prior to confirming your booking

  • Your booking is for a specific time slot on a specific date – you are only permitted to utilise the facility during this period

  • The time slot will be one hour long, but you are allowed only 50 minutes of activity. The other 10 minutes are allow for you to enter, set up, clean and exit the Centre.

Your Legal Rights – At your own risk
The use of our centre and car park is at your own risk. There are various hazards for you to take account of – from uneven ground, to slip hazards, and all things farm and barn related – all of which are things that you would commonly find in a countryside setting.
As the centre operator, we accept no liability for the death or injury, loss or damages and other claims incurred by you or anyone with you, or property, including your dogs during the use of the centre or car park.
To make sure you are aware of the potential risks, please ensure you have fully read and understood this document which covers the elements of the centre and how they must be used.

Our responsibilities
We are responsible for foreseeable loss or damages caused as a result of any negligence or lack of consideration for duty of care to you whilst you are using the centre.
We are not liable for any loss or damage that is not caused by a contractor or employee of the centre.
We do not exclude or limit our liabilities to you where it is unlawful to do so. If we are negligent, fraudulent, misrepresent our services, breach your legal rights in relation to the supply of our services, or fail to supply those services with reasonable care, we can be held liable for any death or injury caused as a result.

If you are using the centre for business purposes, we accept no responsibility for any business loses and you are offered the same legal protection as domestic users. This includes loss of business, interruption, loss of business property and any profit. Use of the centre for business purposes is not permitted without express prior consent from The Canine Activity Centre Ltd. AS a business used, you must have suitable insurance to cover any activity that you may undertake.

 

Our Privacy Policy - How We Use Your Personal Information

We securely store your name, mobile number and email address so that we can communicate with you about your booking. Your payment information is held securely by our 3rd party payment partners Wix, Acuity Scheduling, Stripe and Mailchimp, our digital mailing service.

If you have agreed to receive emails from us other than those that relate directly to your booking, you may occasionally receive an email from us. You can change your communication preferences or unsubscribe at any time.

Booking and Payments

We accept payment via the following methods:

Stripe online payments

All payments will display as Canine Activity Centre

Bookings are not confirmed until payment has been made. This also applies to packages where bookings are deferred

When you make a payment via our booking system, you are asked to agree to these Terms and Conditions – you will not be able to proceed with your booking unless these terms and conditions have been accepted by ticking the box

If you make a booking via any other means, we will send you a copy of these terms and you will need to confirm receipt and acceptance before your booking is confirmed
Before your first booking, and at intervals after that, we will send (via email) you an induction video, which you must have viewed before your use of the Centre.

If you are making a booking on behalf of someone else and will not be attending the session yourself, you must ensure that all parties have read and agreed to the terms and conditions and have watched the induction video provided after booking. You are responsible for anybody who accompanies you or attends the session in your place and this extends to all the liabilities and obligations that make up this contract (agreement)

 

Cancellation and Rescheduling of Your Session
You may cancel or reschedule your session up to 24 hours prior to the time of your session. You can do this by logging onto your account on the booking system, or through the link in your confirmation email. You will receive confirmation of any changes to your booking via email. If possible, please consider rescheduling rather than cancelling, as we are still charged card processing fees for any cancellations. Card processing fees are currently almost 40p per slot, so these soon add up. 

Once a customer reaches 6 cancelations, a 50p fee will be taken from any future refunds, or a bill will be issued, to cover card processing fees and admin.
All refunds are processed manually so this will not be immediate.
No refunds are made for no-shows
If you are late for your session, your time cannot be extended and you must still exit the centre at the end of your booking slot.
You may not extend your session for any reason
There may be circumstances when we close the centre – this may be due to severe weather warnings; hazardous conditions in the centre; or things beyond our control like road closures. In this instance, we will contact you directly and offer an alternative session or a refund. It is for this reason that it is important that the contact details you input at the time of booking are correct

Your Obligations​
The following section details what we expect from you as our customer when using our centre. These obligations are designed to ensure the safety of you; your dog/s; other users of the facilities; and anyone or anything that may be affected by your use of our centre

Canine Health, Welfare and Handling
Please ensure any dog entering the centre is healthy and shows no signs of sickness (for example this includes diarrhoea, vomiting, lethargy, coughing – anything which is unusual for your dog)
You must not bring your dog to the centre if they, or any other of your household pets have shown any signs of sickness in the past 48 hours. There are some vulnerable dogs that use the centre and not adhering to this may put other animals at risk
All dogs attending the centre must be up to date with current recommended vaccines (or titre tested), flea, tick, and worming treatments.
Heavy or harsh handling of dogs is not permitted – this includes both verbal and physical treatment
A dog must never be left unattended in the centre or tethered to anything unless accompanied and for valid reason.
Where dogs are left in vehicles whilst other dogs are trained or exercised, their welfare must be constantly monitored.
Your dog must carry 3rd party liability insurance – you may have this as part of your pet insurance policy but if you are unsure, The Dog’s Trust have an affordable membership https://www.dogstrust.org.uk/support-us/membership which will provide comprehensive 3rd party liability insurance as well as many other benefits.
Dogs in season should not use the centre due to mess and following dogs scent marking.
If your dog is unwell in the centre, please do your best to clear it up and contact us if this is not possible – disease can be transmitted through Diarrhoea and vomit so this is essential for all users health and safety. Cleaning products are available in the human area of the centre and well labelled. Please dispose of this waste in poo bags in the bin provided.
If you dog has a serious accident in the centre please contact us on 07777 176 154 (Canine Activity Centre) or 07929450320 (JCB Animal Physio Rehabilitation Centre which lies opposite the centre) after contacting your vet or the local emergency vet whose details are at the centre along with the First Aid Kits.

The Canine Activity Centre accepts no responsibility for any canine sickness that might come on after a visit to the centre.
           
Use of the Centre​
Please ensure the lead member of the booking has watched the induction video, sent after booking, before arriving at the centre for the session

The gate code will be sent 12 hours in a reminder email - this may go into your junk folder so please keep an eye out for it.

Fencing
The fencing in the outdoor part of the centre is approximately 1.6m in height. This can vary slightly in places as the ground is uneven.

The door on the indoor space is lockable from the inside if you wish to do so.

If the centre is not suitable for your dog because it can squeeze through these gaps or scale this fence height then your dog must be on a lead at all times whilst using the centre.
We aim to provide a safe environment for you to exercise your dog and in order to meet these expectations, the dog centre fences and gates are regularly checked for any breaches or failures.
This regular monitoring limits the likelihood of any holes appearing during hours when the centre is not in use but does not completely eliminate any risk. Breaches can include wild animal intrusion or visiting dogs digging as well as branches falling or failures caused by weather events. On occasion, breaches may occur outside of these times so we expect all users to confirm the centre is safe and secure to their satisfaction before letting dogs loose.
If you notice ANY breach at all, please contact us by phone on 07777 176 154 and if you can take a picture and specify the location, this will enable us to make immediate repairs. If any breach means that your dog is no longer safe, please leave immediately, let us know and we will reschedule your booking.

Parking and Access
Parking is located on site - what three words: grove.nurtures.minority – this What3Words will direct you to the gate. We have parking for multiple cars in the shared  parking area, with one specific space in front of the main gate to the centre. Please be aware that the car park may have other dogs in the vicinity as other businesses use the car park area. All dogs should be on a lead at all times.

The gate is operated by a padlock system. The code is sent 1 hour before your booking via email and sms and is changed regularly. After inputting the code in to the padlock, you need to press the top to release it.

Please ensure you are aware of which way the gate opens.

Arrival and Departure
Your session is from the time booked – please avoid arriving early but in the event that you do, please park in the shared car park. The centre is used by reactive dogs and customers arriving early can cause significant disruption.
Your session is for 50 minutes. You must have left the premises by the end of the hour of your session time so please consider the time it will taker to retrieve your dog, load your car and depart.
Please ensure the gate is both closed and padlocked on your departure with the sign turned to vacant.

If you arrive and the previous user is in the centre, do not approach the centre as they may have a reactive dog or an issue retrieving their dog that your presence will not help. Please call us on 0729450320 and we can contact the user.
Users that repeatedly arrive early or leave late will be refused use of the centre.

CCTV
CCTV is in operation on site, covering the car parking area and inside the centre, which is sign posted.

General Etiquette and Dog Behaviour
Whilst The Canine Activity Centre is designed as a safe and private space for you to exercise and play with your dog, we ask that you make the following considerations during your visit. If you fail to adhere to these requests, we reserve the right to ask you to leave and may lead to refusal of bookings in the future
Please ensure you pick up your dog waste and any general waste and deposit it in the bins on site. Human rubbish to be taken it with you.
There is a lane to the right of the centre, past the big white house. This can be used, as well as the grass verges to encourage your dog to toilet prior to using the centre. This helps enable us to keep the centre as clean and smell free as possible.
Cleaning products are available in the centre, in the human area, for use if your dog does toilet in the centre, which should be cleaned up as if it had happened in your own home. Please ensure that all cleaning products are replaced after use and not left about for dogs to have access to. Dilutions of products are correct to manufacturers guides, but your uses of these products is at the risk to yourself and your dog/s.
Please keep shouting to a minimum.
Please ensure that there is no persistent barking from your dog/s during your session.
Please do not drop any food, litter or treats in the centre, and when using treats on the Sniff Wall please ensure you have removed them all before leaving - some dogs may be allergic to some food ingredients in different treats
Please do not permit digging or scratching at the walls in the centre.
Please report any issues with equipment or the centre as soon as you are able on 07777 176 154 or via email for non-urgent matters.
Please ensure all toys are replaced or your own taken with you and none are left in the centre – this includes any scraps of chewed toys or balls: this is for the safety of all users and avoidance of chock hazards or resource guarding. The toys are in a bucket in the human area. These can be used at your own risk and replaced at the end of each session. 
Please ensure you read this entire document to familiarise yourself with all other terms and conditions of use
If a user arrives late, the booking cannot be extended
Anyone remaining in the centre over their allotted time will need to pay for the additional slot and may be banned from re booking

Family, Friends and Children
You may bring other people with you to the centre under the following conditions:
No more than 2 vehicles per booking unless otherwise agreed and for classes
No more than 4 people in the centre per booking unless otherwise agreed and for classes
No more than 3 dogs for the indoor session and 8 for a party session per booking unless otherwise agreed
All users must be aware of these terms and conditions and by attending you are assuming responsibility for their behaviour and actions whilst visiting the field
Children are welcome but the hirer is responsible for their behaviour and safety at all times
No children under 18 are permitted to use the centre without an adult present
Equipment and structures in the centre are not child safe including bins and none of the equipment provided is for human use.

Environmental Hazards
The centre is part of a business site, although all rural and agricultural businesses. The ground is uneven with areas of longer grass and vegetation and there may have hidden trip hazards.
There are also tree trunks, wood piles and sticks to be aware of.
We make an effort to ensure that there are no highly toxic plants in the outside area but dogs react differently to these things dependent on size, breed and individual genetics. The environment is not sterile and therefore we cannot accept any liability for humans or animals harmed by the natural environment.

As you will see, there are many plants on this list that you may have in your garden so whilst they can be harmful to dogs, not all are poisonous on contact or unless ingested. If there is any vegetation in the centre that is concerning to you, please contact us on 07929450320​

Enrichment, Equipment and Toys
The centre is predominantly designed for the enjoyment of dogs. That means that all equipment is to be used only by dogs with the exception of seating.
Please do not allow your dog to use any equipment unless they are fit and experienced enough to do so. It is your responsibility to ensure your dogs safety whilst playing in the centre.
The guidance boards provided are exercises that you can practise with your dogs, and that we see fit which can benefit your dog mentally and physically. If your dog has an ailment, please check with your vet or professional if you should be performing such exercises in line with their physical capabilities and ailments. You perform these at your own risk.
Obstacles may become slippery from rain or ice so do not use if this is the case.
Humans must not climb on equipment designed for dogs

Waste Removal
Please ensure you pick up your dog waste and dispose of it in the dog waste bins provide, and take human rubbish away with you.
We encourage the use of biodegradable and compostable poo bags and these are available on site should you forget to bring any.
If you have any other waste, including broken toys, please use the general waste bin provided in the human area. Please take any food, food wrapping and human drink cartons home with you.

Smoking and Vaping
Smoking and vaping is strictly prohibited on The Canine Activity Centre premises.
Any person found to have been smoking, or to have allowed someone else to smoke, on the premises will be refused booking in the future. The risk of fire on site is considerable at certain times of the year.
Vaping is strictly prohibited on site – vape juice is highly toxic to dogs and should a pen or bottle of juice be dropped and found by a dog there is a risk of ingestion

Business Users
If you wish to use the centre for conducting your business, please ensure you make contact with us prior to booking.
You will need to provide a copy of your public liability insurance and any appropriate professional certifications and qualifications to operate at The Canine Activity Centre.

DIRECTIONS: The centre is based in the business hub on Pant Wilkin Stables - follow the signs off of the A48 for the Business Hub, down the hill to the very bottom and through the stone pillars - there are log cabins on your left. Follow this road to the end into the car park. The centre is located at the farthest end of the LEFT hand side barns, tucked around the corner at the end. This is opposite JCB Animal Physio Rehabilitation Centre. Please use any available parking spaces.
